Probate Estates

Losing a loved one is always difficult. Grieving can be exacerbated by complicated wills and trusts. The proper distribution of the Estate per the intent of the deceased is required by law. Estates are often contested. Contested estates require a firm with a practice focused in Arizona Probate Courts.

A guardianship can be a proceeding that results in the appointment of a guardian of a minor or an incapacitated adult. The guardian requires continued monitoring by the Probate Court. A guardian is a court-appointed person responsible for the care, custody, and control of the ward.

A conservatorship is useful to protect the assets of a minor or adult when the Petitioner demonstrates the need to the Probate Court. The judge will then sign an order establishing the formal appointment of an individual or company to manage or protect the assets of the protected person.

Mental Health

Per the National Institute of Mental Health, nearly 1 in 5 Americans live with a mental illness. This can range from a minor diagnosis to major life-threatening illnesses that require immediate action. Sometimes, legal action is required to admit the Ward into mental health treatment.

Elder Abuse and Exploitation

Arizona is a great state to retire to. Unfortunately, there are bad actors actively looking to exploit the elderly population. Adult Protective Services handles thousands of cases in Arizona each year. Cases can be matters of neglect or self-neglect. Other matters involve financial exploitation. Our attorneys have handled thousands of these matters.

When the biological parents of a child are not discharging their duties, sometimes extended family members or other parties step in to protect the minor with a dependency action. We have assisted Arizona families in thousands of matters to obtain adequate protection, care, and a stable environment for minors.
